The Lazy Elk Terms & Conditions

By making a reservation with the Lazy Elk, the Guest agrees to the terms and conditions laid out below. “Guest” refers to the person who makes and pays for the reservation. The Guest assumes responsibility for all parties who stay at the Lazy Elk during their reservation period (inclusive of pets). Host refers to the owner of The Lazy Elk and the Property.

Property & Use

The Lazy Elk is located at 1825 Golden Donald Upper Road, Golden, BC, V0A 1H1. The Property being rented is the Lodge at the aforementioned address, which is a 3500 sq ft, 4 bedroom building on the property. Access to the acreage and other parts of the property is included but not on an exclusive basis, as the Host also lives on the acreage. 

Use of the Property and the acreage is at the Guest’s own risk. The Lazy Elk and the Host take no responsibility or liability for accidents or injuries that may occur during the rental period as a result of the Guest’s actions. 

Term of the Lease

The Guest shall have access to the property between 3pm on the start date of their reservation, and 11am on the end-date of their reservation. The Guest shall be granted private use of the property for the duration of their reservations unless the Host requires access (see Access). If the Guest requires a late check-out then they can request that from the Host. If the Guest overstays the check-out time without prior approval then a $100/hr fee will apply.

Occupancy

The Guest agrees to accurately specify how many guests are staying at the Lodge when making their reservation, and to update the Host in the event of a change. There is a firm limit of 8 guests total at The Lazy Elk, unless otherwise agreed with the Host. The Host reserves the right to cancel the reservation and evict the Guest without refund in the event that this limit is breached.

House Rules

The Guest agrees to abide by the House Rules listed below at all times while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while residing at the property.

  • Smoking and Vaping are not permitted inside the building. Ashtrays are provided for outdoor use. Do not dispose of cigarette butts in the grounds / garden – at certain times of year these are a horrendous fire hazard. A minimum fine of $250 will apply for any evidence of these rules being broken. 
  •  A maximum of 2 pets are allowed but they must be identified on the booking. There is a small fee (when added to the booking) to cover the inevitable wear and tear, and additional cleaning required. Pets must not be left unattended in the lodge; must not be allowed on furniture or beds; or allowed to run or play indoors. If your pet isn’t likely to be able to behave in this way, or is anxious around other dogs (we have dogs) we advise you not to bring them as they’ll likely cause damage to the wooden floors / doors. Any images will be charged to the Guest.
  • The hosting of events is prohibited unless an agreement has been made with the host in advance. 
  • Commercial photography and filming is prohibited unless an agreement has been made with the host in advance. 
  • The Lodge is a private space for your enjoyment, but outdoor activities must cease by 11PM – no exceptions. This is to ensure our neighbours are not disturbed.
  • Children must be supervised at all times
  • The Hot tub is used at your own risk. Responsible Hot Tub use expected – Hot tub safety rules are included in the welcome book on arrival. Excessive soiling will incur a charge of $250 to cover additional costs incurred (including compensating the next guests who will lose out on a hot tub for their first night). Children younger than 12 are not allowed in the hot tub. Hot tub temperature is fixed at max setting (104F).
  • The Lodge is a rural property relying on its own water supply and septic system. We ask guests to be especially conscious of water use during their stay, particularly given droughts in recent times. 
  • Motorised recreational vehicles (E.G. ATVs , snowmobiles etc) are not to be used anywhere on the property, we can not ensure that it will be safe for you and it may cause damage to the lawn and trails.
  • There is one outdoor security camera pointing at the entrance to the lodge, which is not to be tampered with.  Wifi must therefore also not be tampered with during your stay.

Events

 

Events are prohibited unless an explicit agreement has been made between the Guest and the Host in advance. Please Contact Us before booking the lodge for an Event.

Rental Rate, fees & payment

The nightly rates and fees for your booking will be detailed during the checkout process. Payment will be collected as follows:

  • 50% payment will be collected at the time of booking 
  • 50% to be collected prior to 14 days before your reservations start date. 
  • Bookings made within 21 days of the check-in date will need to be paid in full.

The Lazy Elk will send a reminder e-mail for payment for the remaining 50%. Failure to provide full and complete payment will result in the cancellation of your booking without refund.

Damages

In the interests of mutual trust and a positive Guest experience, we do not ask for a security deposit from our Guests. However, by agreeing to these terms and conditions the Guest agrees to re-imburse the host for any damages that occur during their stay as a direct result of the Guest’s actions. The Host is responsible for providing evidence of such damage and a quote for the replacement / rectification costs. We very much appreciate honesty on the part of our Guests in this respect.

Access

Guest shall allow Host access to the property for purposes of repair, inspection or emergency. Host shall exercise this right of access in a reasonable manner by giving at least 1 hours notice (unless in case of emergency).

The Host will provide a unique access code for the property to the Guest in advance of their check-in day. This enables the guest to use the main entrance door to access the property without the need for a key.

Cancellation Policy

If the Guest wishes to cancel the reservation, the Guest will be refunded as follows:

100% if canceled up to days 30 prior to the Check-in Date.
50% if canceled days between 30 and 14 days prior to the Check-in Date (effectively meaning the balance payment wouldn’t be expected).
0% if canceled after 14 days prior to check-in date. Refunds may be considered within this period if the Host is able to re-book those dates with new customers, but this is at the Host’s discretion.

100% of any damage deposit collected will be refunded if a stay hasn’t commenced.

The Host reserves the right to cancel the Guest stay if house rules are broken during rental period.

If the Host wishes to cancel the stay for any reason other than due to the Guest breaking house rules (e.g. emergency), then a full refund will be provided.

Extenuating circumstances and Acts of God

We encourage all renters to purchase traveler insurance in case of unforeseen circumstances, accidents or other issues that may prohibit Guest from traveling or fulfilling rental terms. Responsibility for circumstances outside of both the Guest’s and Host’s control will not assumed by the Host. The Guest is therefore advised to seek adequate travel insurance for their stay.
